Kluger Kaplan Secures Favorable Judgment in High-Stakes Estate Dispute Involving $20+ Million in Assets

Attorneys at Kluger, Kaplan, Silverman, Katzen & Levine secured a significant final judgment following a four-day, non-jury trial in a complex estate dispute involving more than $20 million in assets and over two dozen closely held business entities tied to Miami businessman Miguel Nuñez.

The Kluger Kaplan team—Bruce Katzen, Ryan Bollman, and Jean-Pierre Bado—represented Mr. Nuñez’s widow and only daughter in the matter.

A Sweeping Court Ruling

In a detailed 17-page decision, the Court removed Raul Nuñez, the decedent’s brother, from his roles as Personal Representative and Trustee. The Court found that he operated under an “unresolvable conflict of interest” and demonstrated “a callous and arrogant disregard for his fiduciary duties to the Estate and to the Trusts.”

The Court appointed the surviving spouse as the new Personal Representative and Trustee and awarded her and her daughter attorneys’ fees and damages.

Reinforcing Fiduciary Responsibilities

The case involved the administration of a highly complex estate structure, including numerous closely held entities, where fiduciary oversight and transparency were central issues at trial.

The ruling underscores the heightened responsibilities imposed on fiduciaries managing multi-entity estates, particularly where control over business interests is at stake. It also reinforces that fiduciaries must adhere to core obligations of loyalty, impartiality, and full transparency in carrying out their duties.

Strategic Advocacy in Complex Estate Litigation

This outcome reflects Kluger Kaplan’s strength in handling high-stakes estate and trust disputes, particularly those involving intricate business structures and competing fiduciary interests. By combining detailed factual development with strategic trial advocacy, the firm successfully secured a result that protects the rights and interests of beneficiaries in complex estate matters.
