Appellate Practice
Litigation doesn’t end in trial court. Victories and losses aren’t final until they’re final on appeal.
As appellate courts face increasing caseloads and legal issues grow more complex, effective appellate advocacy has become an essential component of modern litigation. At Kluger, Kaplan, Silverman, Katzen & Levine, our Appellate Practice is built to guide clients through critical trial, post-trial, and appellate stages with precision, strategy, and deep courtroom insight.
Led by veteran appellate advocate Jonathan Colan and founding shareholder Steve Silverman, our team brings decades of experience handling high-stakes appeals in both state and federal courts. We approach every matter with the understanding that appellate issues are often shaped long before a case reaches a final judgment.
We are experienced appellate litigators and strategic advisors. But two characteristics distinguish Kluger Kaplan’s Appellate Practice:
Strategic Appellate Advocacy
Every appeal starts with building the record in the trial court. From there, our role is to identify what matters, refine the legal issues, and present them in a way that resonates with the appellate court. The rules and strategies are different in appellate court. But just as an effective trial litigator knows what pretrial and trial strategies will win there, an effective appellate advocate knows how to win in that very different forum.
We work closely with trial counsel, whether inside or outside the firm, to ensure arguments are preserved and positioned effectively. Our team handles appeals across a range of matters, including complex commercial and business disputes, real estate litigation, white-collar cases, and constitutional issues.
Integrated Trial Support
Appellate strategy does not necessarily begin after a verdict. In many cases, it begins at the earliest stages of litigation. We often work alongside trial teams to help frame key issues, anticipate challenges, and make sure the record supports the arguments that may later be raised on appeal. This approach creates continuity and avoids missed opportunities.
The practice also serves as a resource for other law firms seeking appellate support. We regularly collaborate as outside counsel, providing focused guidance without competing for underlying trial work.
At Kluger Kaplan, appellate work is grounded in experience—not just in briefing and argument, but in understanding how cases unfold in the courtroom. That perspective shapes how we approach every appeal and allows us to deliver thoughtful, effective advocacy when it matters most.
